Introduction
1.1 These Terms and Conditions shall apply to all lettings services provided by Duchy Lettings ("we", "us", "our"), a lettings agent operating in Cornwall.
1.2 By instructing us to provide any lettings services, you agree to be bound by these Terms and Conditions.
Services
2.1 We provide lettings services to landlords, tenants and prospective tenants.
2.2 Our services may include marketing the property, arranging viewings, conducting referencing and credit checks, drafting and negotiating tenancy agreements, collecting rent, managing the tenancy, and dealing with any disputes.
Fees
3.1 Our fees will be agreed with you in advance and set out in our Terms of Business.
3.2 Our fees are payable by the landlord unless otherwise agreed.
3.3 Our fees are subject to VAT at the prevailing rate.
3.4 We reserve the right to charge additional fees for any additional services provided outside of our standard service.
Property Listings
4.1 We will list your property on our website and other relevant property portals as agreed.
4.2 We reserve the right to withdraw any property listing at any time.
4.3 We will use our reasonable endeavours to ensure that any property listing is accurate and up to date, but we cannot guarantee this.
Viewings
5.1 We will arrange and conduct viewings with prospective tenants.
5.2 We will use our reasonable endeavours to ensure that all viewings are conducted in a safe and professional manner.
5.3 We will provide feedback on viewings to the landlord as soon as possible.
Tenancy Agreements
6.1 We will draft and negotiate the tenancy agreement on behalf of the landlord.
6.2 We will use our reasonable endeavours to ensure that the tenancy agreement is fair and reasonable to both parties.
6.3 We will provide a copy of the tenancy agreement to the landlord and tenant before the tenancy starts.
Rent Collection
7.1 We will collect rent from the tenant on behalf of the landlord.
7.2 We will use our reasonable endeavours to ensure that rent is paid on time and in full.
7.3 We will notify the landlord if rent is not paid on time and assist in the recovery of any outstanding rent.
Property Management
8.1 We offer a property management service to landlords, which includes dealing with any repairs and maintenance issues.
8.2 Our property management service is subject to additional fees, which will be agreed with the landlord in advance.
8.3 We will use our reasonable endeavours to ensure that any repairs or maintenance issues are dealt with promptly and efficiently.
Liability
9.1 We will not be liable for any loss or damage caused by any act or omission of the landlord or tenant.
9.2 We will not be liable for any loss or damage caused by any act or omission of any third party, including but not limited to contractors or service providers.
9.3 Our liability shall be limited to the amount of our fees paid by the landlord in respect of the relevant service.
Termination
10.1 Either party may terminate our services at any time by giving notice in writing.
10.2 We reserve the right to terminate our services immediately if we consider that the landlord or tenant is in breach of the tenancy agreement or these Terms and Conditions.
General
11.1 These Terms and Conditions constitute the entire agreement between the parties and supersede all previous agreements and understandings, whether written or oral.
11.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales
